Question:

After a recent minor fender-bender, in which a woman motorist backed into my car as i passed down the road. i immediately called my insurance, explained situation, etc. i took all of the woman's insurance and personal info, but didn't file a police report. i was fairly shaken, though it wasn't a severe impact. it made substantial damage to my car, but little to none at all on her suv. i couldn't see the bumper, it was dark, i was confused and couldn't concentrate very well. i also got her plate info. she didn't full-out admit her mistake, but she did say "i'm so sorry," and "i thought you saw me," which proves she SAW me. now, several days later, my insurance tells me she has suddenly changed her story, saying she was parked (standing, idling rather) the opposite way in the street--(she had her suv perpendicular, almost blocking off the street--the right lane WAS OPEN though. the truth is that the back of her vehicle was facing into the street, but now she's claimed it was the front, and that i "tried to squeeze through" AFTER she had already begun to go. last i knew, if a parked, or three-point-turning car hits someone in on-coming traffic, it's his/her fault. the point of all this is that everyone involved is telling me they can't help, nothing they can do, blah blah blah, simply and ONLY because i didn't file a police report. don't they INSPECT the vehicles? I'M ASKING YOU, WHAT CAN I DO TO GATHER EVIDENCE TO CREATE A CASE, AND IS THERE ANYTHING I CAN DO TO PROVE THAT THE ACCIDENT HAPPENED THE WAY EXPLAIN IT--WITHOUT A POLICE REPORT? this woman, the offender, actually has damage on the front of her car, but she's told her adjuster she has no damage anywhere on the rear. that means she either a)deliberately damaged the front of her vehicle to create a case, b) is using damage from a pre-existing accident to help her in this case, or c) that her vehicle has, since our accident, been involved in another impact. MY QUESTION FOR YOU IS, (despite the general opinion of the legal professional community) WHAT CAN I DO IF THE INSURANCE COMPANY WON'T GO THE DISTANCE NECESSARY TO FIND LEGITIMATE PHYSICAL EVIDENCE TO AT LEAST VERY HIGHLY SUGGEST THE TRUE EVENTS OF THAT NIGHT? (sorry to ramble. i'm so overwhelmed at how disinterested the insurance people seem, and especially at how unfortunate it has been to come into contact with such a dishonest woman.)
